BINDING AGREEMENT. These Terms of Use constitute a legally binding agreement between you and pmids.org (“us,” “we,” “Company”) for your use of the Internet site located at https://pmids.org/ (the “Site”). By accessing and using the Site, you acknowledge and agree to comply with these Terms of Use. If you do not agree with these terms, you must immediately cease all use of the Site.

PRIVACY POLICY. We respect your privacy and allow you to control your personal information. Our current privacy policy is fully outlined in a separate document, which you can access by clicking here. This privacy policy is an integral part of this Agreement.

APPLICABLE LAW. These Terms of Use shall be interpreted in accordance with and governed by the laws of California and the United States, without regard to conflicts of law principles. The Site is intended for use by individuals based in the United States of America.

AGE REQUIREMENT. You must be at least 18 years old to access and utilize this site. By accessing the Site, you affirm that you are at least 18 years old and have the legal capacity to enter into this Agreement.

EBOOK SUBSCRIPTIONS AND EMAILS. You may choose to sign up to receive a complimentary eBook from us, which may result in receiving further commercial emails from us.

EMAIL COMMUNICATIONS. When you contact us, you consent to receiving email responses from us. These emails may be of a commercial or non-commercial nature, including administrative communications and updates regarding these Terms of Use, the Privacy Policy, or other site-related matters.

SOFTWARE USAGE. Certain software may be available for download from the Site. If you download software from the Site, the software, its files, images, and associated data (collectively, “Software”) are licensed to you by the Company for personal, noncommercial, home use only.

You acknowledge that the title and intellectual property rights of the Software remain with the Company, and you may not sell, redistribute, reproduce, or convert the Software to human-perceivable form. You may not use trademarks and logos owned by the Company or its licensors.

USER-GENERATED CONTENT. By posting, downloading, displaying, transmitting, or distributing information or content (“User Content”) on the Site, you grant Company a permanent, non-exclusive license to use User Content for the operation of its internet businesses, including the right to copy, distribute, transmit, display, perform, edit, translate, and reformat User Content.
You agree that Company may publish or disclose your name in connection with your User Content. You warrant that you own the rights to User Content or are authorized to distribute it.

INTELLECTUAL PROPERTY COMPLIANCE. You agree to respect the intellectual property rights of others. You shall not violate copyright or other intellectual property rights when accessing the Site.

INAPPROPRIATE CONTENT. You will not upload, download, or distribute Content that is libelous, defamatory, obscene, pornographic, abusive, threatening, or violates any laws or regulations. Company reserves the right to terminate or delete such material.

LIMITED LIABILITY. Our liability to you is limited. We are not liable for any damages, including special, incidental, or consequential damages, arising from your use of the Site.

AFFILIATED SITES. We are not responsible for third-party websites or materials. We make no guarantees about the accuracy, quality, or content of information provided by third-party sites.

PROHIBITED USES. You are prohibited from violating security features, attempting unauthorized access, interfering with service, or transmitting unsolicited email or harmful content.

INDEMNITY. You agree to indemnify and defend us against third-party claims arising from your use of the Site.

SEVERABILITY; WAIVER. If any provision of these Terms of Use is deemed unenforceable, the remaining terms will still apply. No waiver of a breach shall be deemed a waiver of subsequent breaches.

NO LICENSE. Use of the Site does not grant you a license to use our trademarks, service marks, or logos.

UNITED STATES USE ONLY. The Site is intended for use by individuals in the United States. We do not guarantee availability or appropriateness of materials for use in other locations.

AMENDMENTS. We reserve the right to amend these Terms. Notice of material amendments will be provided via email and published on the homepage.
